What an arrest record is
An arrest record documents that a law enforcement agency took a person into custody. It is created at booking and is typically held by the arresting agency or the county jail. An arrest starts a process rather than ending one: charges may be filed, reduced, or dropped, and a case may end in dismissal, acquittal, or conviction.
What arrest records typically include
Some jurisdictions publish booking logs for a limited time; others release very little. What appears in a report depends on what is available for that area.
- Name, age, and description recorded at booking
- Date of arrest and booking number
- The agency that made the arrest
- Charges listed at booking
Reading an arrest record carefully
Treat an arrest entry as a lead to check, not a conclusion. Compare the age, city, and other identifiers with the person you have in mind, then look for the matching court case to see what happened next. The charge listed at booking is often different from the charge that is eventually filed.
Questions
Before you search
- Is an arrest the same as a conviction?
- No. An arrest means a person was taken into custody. Only a court can convict, and many arrests never lead to a conviction. Check the court record for the final outcome.
- Why might an arrest not appear?
- Agencies differ in what they publish, records can be sealed or expunged, and juvenile arrests are generally confidential. No match does not mean no arrest occurred.
- Can I look up my own arrest record?
- Yes. Many people search their own name to see what appears. For an official record, contact the arresting agency or your state’s criminal records repository.
- Are booking photos included?
- Only where a booking photo is available from the sources used for that jurisdiction. Many reports do not include one.
