What a deed record is
A deed is the legal document that transfers ownership of real estate from one party, the grantor, to another, the grantee. Once signed, it is recorded with the county recorder or register of deeds, which gives public notice of the transfer. The recorded deed, and the index entry that points to it, is what people mean by a deed record.
Common types of deeds
The deed type gives useful context: a quitclaim between family members reads very differently from a warranty deed in an ordinary sale.
- Warranty deed: the grantor guarantees clear title
- Quitclaim deed: transfers whatever interest the grantor has, with no guarantee
- Special warranty or grant deed: limited guarantees
- Trustee’s, executor’s, or sheriff’s deed: a transfer made for a trust, an estate, or a court
What deed records typically contain
A deed index entry usually lists the parties, the recording date, the document or instrument number, and the book and page where it was filed. The deed itself adds the legal description of the land and, in many states, the transfer amount or transfer tax. A report organizes available entries so you can follow the transfer history of an address over time.
Questions
Before you search
- What is the difference between a deed and a title?
- A deed is a document that transfers ownership. Title is the legal concept of ownership itself. The chain of recorded deeds is the main evidence of who holds title.
- How do I get a copy of a recorded deed?
- The county recorder or register of deeds where the property sits can provide copies, including certified copies on request. The recording date and instrument number make it easier to find.
- Why might a recent deed not appear?
- Recording and indexing take time, and sources update on different schedules. Very recent transfers may not show yet.
- Does a deed record show mortgages?
- Mortgages and deeds of trust are recorded as separate documents. Where available, related recorded claims appear in the lien section of a property report.
